KELLOGG’S CEREAL BACK TO SCHOOL GIVEAWAY

CONTEST DESCRIPTION

1.1. “ Kellogg’s Back to School Giveaway” begins at 12:00 AM on Tuesday, August 5, 2025. Entries may be submitted up until 9:00 P.M. on Friday, September, 2025. (The “Contest Entry Period”). By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and Conditions and the decisions of Dickerson & Quinn (267 Guerrero Drive Tamuning, Guam 96913) (“Sponsor”). Decisions of the Sponsor shall be final and binding in all respects. The Sponsor shall reserve the right to revise the Contest Entry Period at any time by publishing a notification GuamHome Essentials Facebook page.

2. ELIGIBILITY

2.1. Only legal residents of Guam who are eighteen (18) years of age or older are eligible to participate. Employees of American Grocery locations and their immediate family members, and/or those living in the same household, are ineligible to enter the Contest and/or win a prize.

3. HOW TO ENTER

3.1. During the Contest Entry Period, you will receive an entry form upon the purchase of (1) Kellogg’s Apple Jacks 8.9oz, Froot Loops 8.9oz, Corn Pops 8.9oz or Frosted Flakes 12oz) at Don Don Doni or any Pay-Less Supermarket location.

3.2. In the event, you decided not to purchase, you may enter the Contest by way of obtaining the form from the Sponsor via self-addressed stamped envelope. In this case, only one entry form is allowed per person per day. You must complete and submit your entry form to the Participating Store.

3.3. All submissions received after the Contest Entry Period will be null and void without further notice.

4. WINNER SELECTION AND NOTIFICATION

4.1. Grand prize drawing will be held on September 11, 2025. One winner per store location will win a $500 gift certificate, two winners $250 gift certificate and 5 winners will win $100 gift certificate.Need not be present to win. Prize is non-transferable.

4.2. The winners will be notified via phone by a representative of the Sponsor.

4.3. If, despite reasonable efforts, winners do not respond within seven (7) days of the first notification attempt by the Sponsor's representative via phone, such potential winners will forfeit his or her prize and alternate winners may be selected. The Sponsor, in its sole discretion, will attempt to contact potential winners in accordance with the above procedure, after which the prizes in question may go un-awarded if it remains unclaimed. The Sponsor shall not be held liable in the event the eligible winners cannot be contacted for whatever reasons. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules and Conditions or declines the prize for any reason prior to award, or is found to have tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardize fair and proper conduct of the Contest, such potential winner will be disqualified and an alternate winner may be selected.

5. PRIZE DELIVERY

5.1. The prizes will be picked up by the winner from the Sponsor’s office within 14 days from the day the winner is informed. To the extent permitted by applicable laws, the Sponsor and its employees, agencies and representatives (including its affiliates) associated with this Contest are not responsible for any delay arising from the winner.

5.2. The Sponsor and its appointed fulfillment agency shall be entitled to request the original Government Issued ID or the originals of other supporting documents or materials for verification purposes.

6. PRIZES/APPROXIMATE RETAIL VALUE

6.1. One winner per store (Don Don Doni and Pay-Less location will receive a TOPVISION 7500L portable mini projector, a $100 Netflix Gift Card, (2) cases of Pringles 5.5oz (flavors based on availability). The prize and all elements of the prize must be taken as and when offered or the prize will be forfeited, and if forfeited, the Sponsor will not be liable.

6.2. The Sponsor shall reserve the right at its absolute discretion to substitute the prizes with another of similar value, at any time without prior notice. The prizes are non-transferable, non-refundable and not exchangeable for cash or its equivalent. All prizes are given on an “as- is” basis.

7. RIGHTS OF THE SPONSOR

7.1. In accepting the prize, the winner acknowledges and consents to his/her name, likeness and image being used or posted on GuamHome Essentials Facebook page or elsewhere on the internet as authorized by the Sponsor for the purposes of advertising, marketing, trade and/or publicity without any prior notice. The participants shall not be entitled to claim ownership and/or other forms of compensation for the use of the materials by the Sponsor.

7.2. Interpretation of the contest rules shall be at the sole discretion of the Sponsor. Any decisions made shall be binding on all contestants. The Sponsor's decisions are final.

7.3. The Sponsor reserves the right to modify, suspend and/or cancel the Contest and/or this Official Rules and Conditions at any time by publishing a notification on GuamHome Essentials Facebook

page. You agree that your continued participation in this Contest shall be treated or deemed as acceptance and agreement of this Official Rules and Conditions (as may be amended from time to time).

7.4. All taxes are the sole responsibility of the winners. The Sponsor is not responsible for lost, late, misdirected or mutilated entries.

7.5. The Sponsor reserves the right, in its sole discretion, to disqualify any participant who the Sponsor has reason to believe has breached any of the Official Rules and Conditions contained herein and/or that is found or suspected of tampering with the Contest submission process or the operation of the Contest. The Sponsor reserves the right to pursue legal action against any individual it believes has undertaken fraudulent activities or other activities harmful to the Contest.

7.6. All entries and any copyright subsisting in the entries become and shall remain the property of the Sponsor who may publish or cause to be published any of the entries received.

8. LIABILITY AND RESPONSIBILITY

8.1. Nothing in this Official Rules & Conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory guarantees or warranties.

8.2. To the extent permitted by applicable laws, the Sponsor (including its employees, agencies and representatives associated with this Contest) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:

(a) any technical difficulties or equipment malfunction (whether or not under the Sponsor's control);

(b) any theft, unauthorised access or third-party interference;

(c) any entry, claim or prize that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Sponsor) due to any reason beyond the reasonable control of the Sponsor;

(d) any variation in the prize value to that stated herein; or

(e) any misuse of a prize.

8.3. In the event of any discrepancies between this Official Rules and Conditions and any advertising, promotional, publicity and other materials relating to or in connection with this Contest, this Official Rules and Conditions shall prevail.

8.4. Failure by the Sponsor to enforce any of its rights at any stage does not constitute a waiver of those rights. The Sponsor's legal rights to recover damages or other compensation from such an offender are reserved.

8.5. To the extent permitted by applicable laws, Contest participants and their heirs shall assume full liability and responsibility in case of any liability, mishap, injury, damage, claim or accidents [including death] resulting from their participation in the Contest, redemption and/or utilization of the prize and agree to irrevocably and unconditionally release and hold the Sponsor free and harmless from all losses, damages, rights, claims and actions of any kind arising in whole or in part, directly or indirectly, from participation in this giveaway.

8.6. The Sponsor accepts no responsibility for any tax implications and the participants must seek their own independent financial advice with regards to the tax implications relating to the prize or acceptance of the prize.

9. GENERAL TERMS AND CONDITIONS

9.1. By entering this Contest, the participants agree to be bound by the Official Rules and Conditions and the decisions of the Sponsor shall be final and binding. No appeal shall be entertained for any reason whatsoever.

9.2. The Sponsor reserves the right, at any time, to validate and check the authenticity of the entries and entrants' details (including an entrant's identity, age and place of residence). Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Sponsor's discretion be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that participant invalid.

9.3. The Official Rules and Conditions and the Contest mechanics may be amended from time to time and shall prevail over any provisions or representations contained in any other promotional material or advertising of the Contest.

9.4. The Contest and this Official Rules and Conditions shall be governed by the laws of Saipan and be subject to the exclusive jurisdiction of the courts of Guam. If any of the provisions of the Official Rules and Conditions is adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms and conditions contained herein shall otherwise remain in full force and effect and remain enforceable between the parties.
